1. Who we are
Heater Partners is operated by [LEGAL ENTITY NAME], registered in [COUNTRY] under number [REGISTRATION NUMBER], with registered office at [ADDRESS] ("we", "us", "the Company"). Contact: [CONTACT EMAIL].
2. Scope
These Terms govern the submission of an application to join the Heater Partners affiliate program ("Program"). Submitting an application does not create an affiliate relationship. If your application is approved, your participation will also be governed by the Affiliate Agreement and any brand-specific terms, which will prevail in case of conflict.
3. Application and approval
3.1 Submitting the signup form is an application only. It does not entitle you to join the Program or to earn any commission.
3.2 We may accept or reject any application at our sole and absolute discretion, for any reason or no reason, without having to give an explanation.
3.3 We may request additional information or documents (including identity, company, tax, payment and traffic-source details) before deciding on your application, and may reject it if these are not provided.
3.4 Approval may be revoked at any time if we later find that any condition of these Terms is not met.
4. Eligibility
You confirm that you are at least 18 years old (or the age of majority in your jurisdiction, if higher), have the legal capacity to enter into binding agreements and, if applying on behalf of a business, are authorized to act for it. You are solely responsible for complying with all laws applicable to you and to your marketing activities, including gambling advertising rules in each market you target.
5. Accuracy of information
You warrant that all information you provide is true, accurate, complete and kept up to date. Providing false, misleading or incomplete information is grounds for immediate rejection of your application or termination of your account, and for the withholding or forfeiture of any commissions.
6. Account credentials
You are responsible for keeping your username and password confidential and for all activity carried out through your account. Notify us immediately at [CONTACT EMAIL] of any unauthorized use.
7. Personal data
7.1 We process the personal data you submit (such as your name, company details, address, e-mail and username) to assess your application, verify your identity and business, prevent fraud, manage our relationship with you and comply with our legal obligations.
7.2 The legal bases are the steps necessary before entering into a contract with you, our legitimate interests in operating a secure and fraud-free Program, and compliance with legal obligations. Where you give optional consent to marketing communications, we rely on that consent, which you can withdraw at any time.
7.3 We may share your data with the casino operators whose brands are part of the Program, and with service providers acting on our behalf (such as hosting, affiliate-tracking and payment providers), under appropriate safeguards.
7.4 If your application is rejected, we may retain your data for up to [24] months for fraud-prevention purposes and to defend legal claims, after which it is deleted.
7.5 You have the rights provided by applicable data protection law, including access, rectification, erasure, restriction, objection and portability, and the right to lodge a complaint with a supervisory authority. Full details are in our Privacy Policy.
8. No guarantee
We make no representation or guarantee as to the earnings, traffic or results you may achieve through the Program.
9. Marketing conduct
If approved, you agree not to target minors or vulnerable persons, not to send unsolicited communications, to promote responsible gambling, and to follow all brand guidelines and restrictions communicated to you (including on paid search and brand bidding). Breach of this clause may lead to immediate termination and forfeiture of commissions.
10. Intellectual property
All Program names, logos and materials remain the property of the Company or the respective brand owners. Nothing in these Terms grants you any right to use them except as expressly permitted in the Affiliate Agreement after approval.
11. Suspension and termination
We may suspend or close any account, at our discretion and with immediate effect, in case of suspected fraud, breach of these Terms or of the Affiliate Agreement, or where required by a brand partner or by law.
12. Limitation of liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental or consequential loss, loss of profits or loss of opportunity arising from the rejection of an application, the suspension or termination of an account, or the use of the website. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnity
You agree to indemnify the Company against any claim, loss or expense arising from your breach of these Terms or of applicable law.
14. Changes
We may amend these Terms at any time. The updated version will be published on this page with a new version date. Continued use of the Program after publication constitutes acceptance of the updated Terms.
15. Governing law and jurisdiction
These Terms are governed by the laws of [JURISDICTION]. The courts of [CITY, COUNTRY] have exclusive jurisdiction, without prejudice to any mandatory consumer protection rules that may apply.
16. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
